State of Vermont Windsor County, ss IN RE: DISCONTINUANCE OF TOWN HIGHWAY NO. 71 ORDER The above matter was heard by the Selectmen of the Town of Hartland at Daman Hall, in the Town of Hartland, County of Windsor and State of Vermont, at 7:30 P.M. on Thursday, October 9, 1969, in accordance with notice in the following form: “The Selectmen of the Town of Hartland, a municipal corporation having its situs at Hartland, in the County of Windsor and State of Vermont, will meet at Damon Hall in that Town at 7:30 P.M. on Thursday, October 9, A. D. 1969 for the purpose of hearing all interested parties on the question of whether they should discontinue as a public highway that portion of Town Highway No. 71 beginning at the intersection of that highway with the public highway running from Hartland Four Corners to Woodstock and commonly known as Town Highway No. 22 on the easterly line of land of Constantin A. Pertzoff and the westerly line of land of Constantin A. Constantin A. Pertzoff and continuing northerly to the private yard of Constantin A. Pertzoff. Dated at Hartland this 8th day of September, A. D. 1969. Selectmen of the Town of Hartland Harold W. Harbour Charles R. French William E. Campbell ” A copy of that notice was posted in the town Clerk’s office in Damon Hall on September 9, 1969. Copies of notice were also sent by registered mail to Mr. Constantin A. Pertzoff on September 9, 1969 and return receipt showing receipt of the notice was received from him and on September 24, 1969 to the Hartland Planning Commission, Attention of Cordelia Newton , Chairman. A copy of the notice was published in the VALLEY NEWS on September 26, 1969. At the hearing there were present Selectmen Harold R. Barbour, Charles R. French and Page 2 of 2 William E. Campbell and Town Manager Walter R. Hazard. No objection to the discontinuance of said highway was made by anyone and no claim for damages was asserted by anyone. Therefore, we, the said Selectmen judge that the public good requires that said highway be discontinued and said highway is herby discontinued. Dated at Hartland, in the County of Windsor and State of Vermont this 15th day of December, A. D. 1969. |

State of Vermont Windsor County ss In Re: discontinuance of Part of Town Highway 50 as a Highway, continuance as a trial The above entitled matter came on for hearing before the Selectman of the Town of Hartland on the 23 rd day of September, A. D. 1961, pursuant to notice thereof in the following form. Where as, petition has been filed to discontinue as a highway and lay out as a trail that part of Highway No. 50 between the house formally owned by Fred Rice and now owned by Canaday, and the intersection of Highway No.48 with Highway No. 50. Which Highway was laid out by the Selectman of Hartland as shown in the Town proceedings, Vol. 4 page 50 & 51, therein described as follows; beginning at the Northwest corner of David Rice’s new barn, thence south 64 deg east 22 rods to a stake and stones; thence South 59 deg east 21 rods and 19 links to a stake 1 foot North of a small maple tree; thence South 67 ½ deg East 8 rods to a stake; thence North 66 deg East 9 rods 10 links; thence South 37 deg 10 rods to the road near Nathan Kitridge house in said road, surveyed on the South side and laid 3 rods wide. Now, therefore, notice is hereby given that the Selectman of the Town of Hartland will meet at Damon Hall in the Town of Hartland at 10:00 o’clock in the forenoon, Saturday September 23 rd 1961, for the purpose of hearing parties interested and for examining the premises to determine whether the described highway should be discontinued as a Town Highway, whether the highway should be continued as a trail and for the determination of any other facts required by law to be determined under the petition. Dated at Hartland in the County of Windsor and State of Vermont, this 8th day of September A. D. 1961. Louis E Maxfield Kenneth J Murphy Selectman Notice in writing was sent by registered mail to each of the signers of the petition in this matter, namely, Mary R Canaday, Marjorie C Morley, Ernest Lovett Gardner, and Philip S Garceau on September 9, 1961 and return receipts were duly received from each addressee. At the hearing there were present: Sidney N. Hammond, Louis Maxfield, and Kenneth J. Murphy, the Selectman of the Town of Hartland: Donald Frail, Town Manager: Mary Canaday and Frank Canaday, Petitioners and owners of abutting properties; Elizabeth Sherburne, Attorney for M & Mrs. Canaday , Max Rogers Town Clerk: Lewis E Springer Jr. Town agent and Attorney. Upon hearing Parties and examination of the highway, it is found 1. That part of the Town Highway No. 50 running from the former Fred Rice residence (originally David Rice) to the intersection thereof with Town Highway No. 48, as described in the Town Proceedings Volume 4, Page 50 & 51 is now impassable by vehicle traffic for some years and is needed and wanted by horseman as a trail. 2. The abutting owners desired to have the highway Altered in Status to that of a trail, and they have no objection to its discontinuance as a highway if it is continued as a trail 3. Other Property owners on the highway, namely, Garceaus, are petitioners, and have no need for the continuance of the part of the highway described in the petition and in the notice of the hearing as a highway, but they do desire the highway altered in status to that of a trail. 4. The public convenience and necessity no longer required the continuance of the highway as a highway, but is required it’s continuance as a trail. It is, therefore, Ordered that Town Highway No. 50 running from the former Fred Rice’s residence to the intersection thereof with the Town Highway No. 48 , as described in Town Proceedings, Vol. 4, page 50 & 51, is hereby discontinued as a Town Highway and is constituted as a Trail. |

Inhabitants of said Hartland for the purpose layout a road from the road now running from Aaron Williard to Holmes Cushman through land of William Hills and William J. Ashley to the road leading from said Cushman's to Aaron Damon Jr.'s. We did also on the day above written lay out a route from the road as it runs from said Cushman's to said Damon's to the Northerly line of the road laid out as aforesaid through said Hills and Ashley land and on the same day did cause the following surveys thereof to be made by Moses Tewksbury. State of Vermont, Windsor County - Be it remembered that at Hartland on the 17th day of June 1837 we the Selectmen of Hartland surveryed and opened a road in said Hartland described as follows: Survey of a road 3 rods in width and surveyed in the center beginning at a stake on the West side of the road which runs from Three Corners to the North village and 4 rods North from the Northeast corner of the burying ground, which is North of Joseph Livermore thence North 2 deg. East, 37.5 rods to a pine stump - thence North 5 deg. East 21 rods on D. H. Sumners land - thence North 5 deg. East 27 rods thence north 4 deg. W. 8 rods on to a bridge thence North 18 deg (?) east 5 rods to an Apple tree, thence North 58 deg East 10 rods to the old turnpike road and on land of Thomas Rogers, thence North 40 deg. East 26 rods thence North 48 deg. East 16 rods, thence North 40 deg. East 38 rods to the junction of the two roads south of Aron Crandells - the three last points are in the old road. We have discontinued and set over the old road through David H. Sumners land to him the said Sumner and have allowed the said Sumner five dollars as damages for laying said road through his land. ..and through Thomas Rogers land we have set over the old road to him the said Thomas Rogers and said road is laid three rods in width surveyed in the center . We have since the survey varied the same at the bridge across the gulf (?) for the convenience of making the same about 3 rods to the East of the above survey. |

We have discontinued the old road having nearly the same discription as the above new laid road and have set the same over to John Lawton's whose land it went through. We have discontinued the road through Thomas Lawton's and John Lawton's land rendered useless by the laying of a road by Courts Committee on the petition of H S Alexander and others have set the same over to the said Thomas and John Lawton so far as it went on their land and to John Short - we have set the old road through his land to near the pine stump so called - we have also discontinued the old road commencing at Hiram Gilsons. Order The above entitled case come on for hearing before the selectmen of the Town of Hartland on 22nd day of October, AD 1952 pursuant to notice thereof in the following form: You are hearby notifid that the Selectmen of the Town of Hartland will meet at Damon Hall in the village of Hartland on the 22nd day of October, AD 1952 at eleven oclock in the forenoon, to examin the premises and to hear all persons interested in the proposed discontinuance of the following described highway. Being .5 miles of Town highway no 7. As shown on map no. T.-36 Vermont Highways District no 4 issued in 1949, for the Town of Hartland, being that portion of the said road running from Skunk Hallow Road to Hartland Hill Road from the Lord place to Adele Heneault Place. The said notice was sent by resistered mail October 9-1952 to the following named persons. Amlu (?) Lord Flint, Merton Lord, Mathew Watson, Carroll F Snelling, return receipts were received from the above persons. At said hearing Carroll F Snelling was present. Upon examination of the premises and hearing of the parties interested, it is hereby found: That the .5 mile of Town Highway no 7 running from Skunk Hallow Road to Hartland Hill Road, from the Lord place to Adele Heneault place, is wholly within the Town of Hartland that it has not been made to appear that said highway was originally laid out under the directions of the county court or the Supreme Court that there is no objections by the abutting land owners, nor by any other person, to the closing of the said highway as a Public Highway from the Snelling place to Hartland Hill Road, but that Carroll F Snelling an abutting land owner, desires to have the said Highway left open from the Lord place to Snellings camp. Wherefore; It is ordered that that portion of Town Highway no 7 running from the Snelling place to Hartland Hill Road to be and hereby is discontinued as a public Highway; but that portion of said Town Highway running from the Lord place to Snellings Camp is to be left open. This order is effective at the time of its recording in the office of the Town Clerk of said Town of Hartland Dated at Hartland, in the county of Windsor, this 31st of December 1952. The said Notice was sent by registered mail Oct. 9 1952 to the following named persons. Carl Lamb, Nath. Jenne Est., A R McEwen, Andy Belisle, Herbert Angier, James Parker, LE Merrit Est., Mrs. Bertha Burnham. Return receipts were received from the above persons. At the said hearing the following Persons appeared. Paul Kendall, Ruth Jenne. Upon examination of the premise and hearing of the Parties interested it is hereby found. That the two miles of Town Highway No. 51 being that portion of the said road known as The Old County Road, running from the Old Burk Stand to the Old Cady House on South Woodstock road and wholly within the Town of Hartland ;that it has not been made to appear that said highway was originally laid out under the direction of the County Court or the Supreme Court that there is no objection by the abutting Land owners, nor any other person, the closing of the said Highway as a public Highway, but that Paul Kendall and Ruth Jenne, abutting Land owners, desire that the said highway shall be continued as a trail, that the said highway is not convenient and necessary to the inhabitants of Hartland, nor does the public good require maintenance of the said highway as a public highway, that the said highway should be discontinued as a Town Highway, and the same is hereby discontinued as a highway but is continued as a trail. Wherefore, it is ordered that that portion of Town Highway No. 51 know as the Old County road running from the Old Burk Stand to the Old Cady Place on South Woodstock road be and hereby is discontinued as a Public Highway, but that it is continued as a trail. Upon examination of the premises and hearing of the parties interested, it is hereby found: The 1.2 of a mile of town Highway 64 running from Stanley Craig’s place to the ErrolRrice place, known as the Sargent Road, is wholly within the Town of Hartland; that is has not been made to appear that said highway was originally laid out under the direction of the County Court or the Supreme Court; that there is objection by these persons present at the hearing, as abutting land owners, to the discontinuance of the above described portion of the said road, it appearing that the maintenance of the said highway is convenient and necessary to citizens of the Town of Hartland, or some of them, ‘Wherefore, It is Ordered that the portion of Town Highway No. 64, running from Stanley Craig’s place to the Errol Rice place, known as the Sargent Road be and hereby is continued. State of Vermont, Windsor County, S.S. In Re: Discontinuance of .88 Miles of Town Highway No. 48 (Reeves Rd. ?) Vol. 5, Page 152-153 Order The above entitled case came on for hearing before the Selectmen of the Town of Hartland on the 22nd day of October AD 1952, pursuant to notice thereof in the following form: “You are hereby notified that the Selectmen of the Town of Hartland will meet at Damon Hall in the Village of Hartland on the 22nd day of October, AD 1952 , at nine o’clock in the forenoon, to examine the premises and to hear all persons interested in the proposed discontinuance of the following described highway: Being .88 miles of Town Highway No. 48, as shown on Map No. 2-36, Vermont Highways, District No.4, issued in 1949, for the Town of Hartland, being that portion of the said road running from the so- called figure eight at intersection of French hill road and Highway No. 53 to Jenneville schoolhouse.” The said notice was sent by registered mail, October 9. 1952, to the following named persons. Mrs. Mabel Lenois,(sp) Elizabeth Morgan Jay, S.C. Sperry, Jr. Return receipts were received from the above named persons. At said hearing the following persons appeared: Ruth Jenne, Administratrix of the Nathaniel Jenne Estate, Mrs. Elizabeth M. Jay. Upon examination of the premises and hearing of the parties interested it is hereby found: 1. That the .88 miles of Town Highway No. 48 being that portion of the said road running from the so-called figure eight at intersection of French Hill road and Highway No. 53 to Jenneville schoolhouse, is wholly within the Town of Hartland: that it has not been made to appear that said highway was originally laid out under the direction of the County Court or the Supreme Court; that there is no objection to closing that portion of the said road running from the French Hill road to the Sperry residence; that there is no objection on the part of Mr. Sperry to the closing of the said highway from his residence to the Jenneville schoolhouse; that said highway is not convenient and necessary to the inhabitants of Hartland, nor does the public good require the maintenance of the said highway; that the convenience and necessity of Mr. S.C. Sperry require the maintenance of the said highway from his residence to the Jenneville schoolhouse and that the portion of the said highway running from the French Hill road to the Sperry residence should be discontinued: Wherefore, It is Ordered that that portion of the Town Highway No. 48 running from the so-called figure eight at the intersection of French Hill Road to the Sperry residence be and hereby is discontinued. This order is effective at the time of its recording in the office of the Town Clerk of said Town of Hartland. Dated at Hartland, in the County of Windsor, this (no day recorded)day of December 1952. Discontinuance of Hartland town highway 13 Volume 5 pages 202-203 The undersigned, selectmen of the Town of Hartland, County of Windsor and State of Vermont, met at Damon Hall in that town on Tuesday, November 21, A. D. 1961, for the purpose of hearing(sic) all interested persons on the question whether the public good requires that they discontinue Town Highway No. 13, running from its intersection with the public highway running from Hartland to Hartford and commonly known as U. S. Route 5 westerly through the land recently acquired by the United States of America in fee for the construction of North Hartland Dam & Reservoir. There were present, in addition to all of the undersigned, Town Manager Donald Frail and Town Attorney Lewis E. Springer, Jr. representing the Town of Hartland. On hearing the evidence produced, it is found that notice of the hearing was given by the selectmen to all interested persons by posting in two public places in the Town of Hartland and by sending duplicate originals thereof by certified mail to the United States of America through the Division Engineer, US Army Engineer Division N. E., Corps of Engineers, 424 Trapelo Road, Waltham 54 Mass.; that a return receipt was received signed by F. D. Bresette as agent of the addressee; that Town Highway No. 13 has been abandoned as far as public use is concerned for more than one year; that the public good no longer requires the continuance of the highway as a public highway; and that the public good does require that the highway be discontinued as a public highway. It is, therefore ORDERED that Town Highway No. 13 be discontinued as a public highway, effective upon the filing of this order in the Town Clerk’s Office in the Town of Hartland. It is also ORDERED that the land within the right of way of Town Highway No. 13 be, and it is hereby, set to the United States of America as the abutting owner of both sides thereof, and that this disposition constitutes full provision as to damages because of the discontinuance so ordered, no evidence having been presented to establish any other damage or claim of damage. On hearing the evidence produced, it is found that notice of the hearing was given by the Selectman to all interested persons by posting in the two public places in the Town of Hartland and by sending duplicate originals thereof by certified mail to Harley Cloud, Frances E. Larrabee and the Division Engineer, U.S. Army Engineer Division , NE, Corps of Engineers, 424 Trapelo Road, Waltham 54, Mass.: that each of the parties named above to whom notice was sent by certified mail received the notice and returned a receipt therefore; that the portion of Town Highway No. 11 described above has been abandoned as a public highway as far as use is concerned, a new highway having constructed southerly thereof which is to be conveyed to the Town of Hartland by the United States of America under a certain contract between the Town of Hartland and the United States of America; and that the public good and necessity no longer require continuance of that portion of Town Highway No. 11 which is the subject of the hearing as a public highway, but does requ8re the discontinuance thereof as a public highway. It is, therefore, ORDERED that that portion of Town Highway No 11 lying within the lands of Harley Cloud and Frances Larrabee and the area of flowage of North Hartland Dam & Reservoir be discontinued as a public highway, effective upon the filing of this Order in the Town Clerk’s Office of the Town of Hartland. It is also ORDERED, under 19 VSA ss 535, that that portion of the highway so discontinued which lies within the lands of Harley Cloud be set, and is hereby set, to Harley Cloud ; that that portion of the highway so discontinued which lies within the lands of Frances E. Larrabee be set, and is hereby set, to Frances E Larrabee; and that that portion of the highway so discontinues which lies between the lands of Harley Cloud and Frances Larrabee, it being impossible to determine to which lot that portion originally belonged, be set, and is hereby set, by equal division thereof by a line constituting the center line of the right of way, one-half to Harley Cloud and the other to Frances E. Larrabee, the portion set to each being that portion contiguous to their respective lands. This disposition of the lands of the discontinued highway constitutes a fixing of damages by reason of the discontinuance above ordered, no evidence of damage having been presented. In Re: Discontinuance of Town Highway NO.55 Order The above matter was heard by the Selectman of the Town of Hartland at Damon Hall, in the Town of Hartland, County of Windsor and State of Vermont, at 1:30 P.M. on Saturday, December 22, 1962, In accordance with notice in the following form: “ The Selectman of the Town of Hartland will meet at Damon Hall, in the town of Hartland, County of Windsor and State of Vermont, at 1:30 P.M. on Saturday, December 22, 1962, to hear all persons who may wish to be heard on the question whether the highway described below should be discontinued as a public highway and continued as a trail. Town Highway No.55, which appears to have been laid out by Humphrey Road, Samuel Perkins and Oliver Gallup, Selectman of the Town of Hartland, on September 12, 1799, as shown by the record thereof recorded on Vol. 1, Page 151 of Hartland Road Records and therein described as follows: ‘A survey of a road beginning at Noah Jenney’s shop. From thence S 13 degrees E 20 rods-S 10 ½ degrees W 44 rods – S 32 ½ degrees W 62 rods – S 4 degrees W 31 rods to Windsor line. Laid tow rods wide and surveyed in the middle, on the 12th of Sept. by Stephen Maine.’ The portion of the described road to be discontinued is that portion running from the intersection of Town road No. 56 to the West Windsor line; and that section is to be continued as a trail under the proposal to be considered on the above hearing. Dated at Hartland, in the County of Windsor and State of Vermont, this 6th day of December, A.D. 1962. Sidney N. Hammond Kenneth J.Murphy Selectman of the Town of Hartland, Vermont” A copy of that notice was posted in the Town Clerk’s Office in Damon Hall, and in the store of Clarence and Anne Sleeper known as “The Shopping Center” on December 8, 1962. Copies of the notice were also sent on that day by registered mail to Mrs. Elizabeth M. Jay, and to Mr. Ralph C Welsh and Mrs. Helen M Welsh, and return receipts showing the receipt of the notices were received from them. At the hearing there were present Selectman Sidney N. Hammond and Louis Maxfield, Town Manager Donald A. Frail and Lewis E. Springer, Jr., attorney for the Town of Hartland. Upon hearing the evidence and viewing the premises, it is hereby found that notice was properly given under the statute to the only abutting land owners, namely, Elizabeth M. Jay, and Ralph C. & Helen M. Welch; that the highway to be discontinued, as described in the notice of the meeting, was laid out entirely within the Town of Hartland by sole action of the then Selectman of the Town of Hartland; that the public good and necessity no longer require the continuance of the road as a public highway but does require the continuance as a trail; and that appears to be no objection to the discontinuance of the road and continuance as a trail. Wherefore, it is ORDERED that that portion of town highway No.55 running from its intersection with town highway No.56 to the West Windsor town line is hereby discontinued as a public highway and its continued and established as a trail.
